Correction of Noncompliance
Correction of noncompliance consists of a two-part process. The first is to correct any individual noncompliance and address policies, practices and procedures through professional learning needed in the LEA. The second is to ensure systemic compliance is occurring for the LEA regarding Timelines.

The LEAs reporting < 100% on Initial Evaluations (Indicator 11) or Transition Timelines (Indicator 12) are considered noncompliant. The LEAs will participate in both correction of noncompliance (Prong 1) and systemic compliance (Prong 2).
LEAs (Superintendent and Special Education Direction) receive a portal e-mail notification of noncompliance in mid-August. The District Liaison (DL) will also receive a copy of the email.
For correction of noncompliance, LEAs must submit the following in the Timeline application:
- Brief narrative about the policies, procedures and practices that were revised to support correction of noncompliance.
- List of the students counted as late for Initial Evaluations Reported Late (Indicator 11).
- It includes basic demographic information, GTID, date of consent to evaluate, 60-day due date, date of completion of the evaluation and reason for the delay.

Systemic Compliance (Prong 2)
By late September, noncompliant LEAs will receive an email stating that “Systemic Compliance (Prong 2) Data Submission” will be available late September through the end of October. It is a pre-collection of the current year’s timeline report. It includes the students, including BCW students, from July 1 to October 31 of the current year.
For systemic compliance, LEAs are required to submit a Child Find (Initial Eligibility Timeline Summary and an Early Childhood Transition (Babies Can’t Wait) Timeline Summary in the Timelines application (Prong 2) on or before October 31. The report should include all initial eligibilities and Babies Can’t Wait transitions due between July 1 and October 31.
This is collection is like the annual collection. All the same fields are reported. If the LEA does not have any transition students, the LEA will report 0.

LEAs compliant with systemic compliance (Prong 2) will receive a clearance letter.
LEAs that are noncompliant on systemic compliance (Prong 2) will receive notice of their status by November. DL will reach out to provide technical assistance and support to the LEAs. The DLs will reach out to the Special Education Directors after notification has been sent. DLs will also receive a copy of the letter. The DL will discuss compliance status (Indicator 11, 12 or both). The DL will send a Timelines Narrative and Professional Learning form through the portal email with instructions for completing.
