Services Plan (SP)
For students who are not publicly enrolled, we are required to offer FAPE. The IEP Team should do a thorough job of explaining to the parent the special education services and supports which would be offered if the student were publicly enrolled. The parent may accept or decline this offer. If the parent declines the offer but requests an SP, then an SP can be created instead of an IEP.
Students must be enrolled in a nonprofit private school in order to be served under a Services Plan.
The Every Student Succeeds Act of 2015 (ESSA), like the earlier No Child Left Behind Act of 2001 (NCLB), requires LEAs to ensure that private schools that participate in equitable services have active nonprofit status.
