Federal Requirement
Section 1412 (a) (11) (A) of the Individuals with Disabilities Act (IDEA) establishes that the State Educational Agency (SEA) is responsible for ensuring that all IDEA requirements are met; and all educational programs for children with disabilities in the State, including all such programs administered by any other State agency or local agency, are under the general supervision of individuals in the State who are responsible for educational programs for children with disabilities; and meet the educational standards of the SEA.
Integrated monitoring activities are a key component of Georgia’s general supervision system. Specifically, integrated monitoring activities are a multifaceted formal process or system designed to examine and evaluate a Local Education Agency’s (LEA) or Early Intervention Service's (EIS) programs or provider’s implementation of IDEA with a particular emphasis on educational results, functional outcomes, and compliance with IDEA programmatic requirements.
Under IDEA Part B, the SEA must monitor the LEAs located in the State in each of the following priority areas: the provision of a Free Appropriate Public Education (FAPE) in the least restrictive environment (LRE); general supervision, including effective monitoring; child find; a system of transition services; the use of resolution meetings; mediation; and disproportionate representation of racial and ethnic groups in special education and related services, to the extent the representation is the result of inappropriate identification. 34 C.F.R. § 300.600(d). Additionally, the Office of Special Education Programs (OSEP) also expects swift identification and correction of noncompliance and increased accountability through timely and accurate data to ensure the full implementation of IDEA.
As part of our robust general supervision systems, the Overdue Eligibility and IEP application is available to LEAs in the GaDOE web portal. The Overdue Eligibility and Individualized Education Program (IEP) application gives a list of students with disabilities whose last reported eligibility was over 3 years ago and/or last reported IEP over one year old. The list also includes students whose age is over 9, and the primary area is Significant Developmental Delay (SDD).

Students listed in the application are populated from error lists from the most recently completed Student Record (SR) Data Collection.
General Guidance
- A failed vision and/or hearing screening is not an acceptable/excusable explanation for delayed/late timelines. LEAs should review policies and procedures to correct this problem.
- Any student with an overdue eligibility or IEP when the LEA signs-off on SR will appear in the application the following year.
- Students will appear in the application for consecutive years if they have been overdue in a prior year.
- Students may have more than one error listed.
- Any overdue eligibility or IEP should be documented in the application during the current school year.
- Data must be completed for each student listed in the application.
- The data entry form is dynamic and adjusts requirements based on selections.
- Some responses require documentation uploads, while other responses do not.
- Ongoing tracking is essential to ensure accurate data and identify areas for correction.
