Corrective Action Plan (CAP) 

LEAs who have a noncompliant finding will complete a Corrective Action Plan (CAP) that will outline the activities that must be completed to correct areas of noncompliance. GaDOE staff assist LEAs with completing their CAP. A CAP may require revision to be accepted. Throughout the entire process, technical assistance and on-going professional learning is provided to LEAs. Periodic check-ins are provided by the DL and the Georgia Learning Resource System (GLRS) Director throughout the year. 

 

**Note that the file uploading process for the CAP, Individual Correction of Noncompliance (Prong 1) and Systemic Compliance (Prong 2) documents is the same as mentioned above in the Compliance Review Section.  

 

Process for Student Withdrawal (if noncompliant in student records) 

If students have withdrawn from the LEA, graduated, or exited special education (no longer eligible or parental revocation) before the date of the file download, the LEA will need to contact their assigned DL and let them know that student is no longer a student with a disability (SWD) within their LEA. They will not be required to submit Prong 1 documentation for that particular student. LEAs will be asked to provide the withdrawal date or exit date and an explanation for the student via a word document and upload that document to the portal. 

 

Individual Correction of Noncompliance (Prong 1) 

In this phase of the CAP, the LEA must act by: 

  • Correcting every instance of noncompliance during the individual student record review, and 
  • Correcting every instance of noncompliance found during the review of written policies, practices, and procedures by submitting revisions in the identified area (s), and  
  • Facilitating Professional Learning (PL) to ensure all teachers and administrators are fully informed about the updated policies, practices, and procedures. 

 

Individual correction of noncompliance must be reviewed and approved by the date indicated by the Results Driven Accountability (RDA) unit. 

 

Systemic Compliance (Prong 2) 

In this phase of the CAP, the LEA must demonstrate that it is correctly implementing the specific regulatory requirements (i.e., achieved 100% compliance), based on a review of updated data. Systemic compliance must be demonstrated by the LEA during this phase by: 

  • Facilitating ongoing Professional Learning to address areas of noncompliance identified during the student records review to ensure all teachers and administrators are full informed about their responsibilities for implementing compliant practices, and 
  • Provides evidence of sustained supervision to monitor the implementation of compliant practices for implementing the applicable state rule. 
  • For Child Find only, the LEA publishes annual notice of any significant activity that is designed to identify, locate, or evaluate children using some type of media to publicly notify parents. 
  • Submitting a specific number of individual student records not previously reviewed that show systematic compliance in the area(s) for which noncompliance was found during the initial student record review.  
  • For Identification, LEAs will submit twelve (12) records in the specific identification category and 2 ineligible files. 
  • For Placement, LEA’s will submit  
  • For Greater than 10 Days, Total Disciplinary Removals, and Significant Discrepancy, LEAs will submit 10 files of students removed greater than 10 days. Removals include both In School Suspension (ISS) and Out of School Suspension (OSS). If an LEA does not have 10 students that have been removed greater than 10 days this school year, then one of the 2 scenarios would apply: 
  • Select 10 students suspended for more than 10 days this school year and submit the required files. If you do not have 10 students to submit, submit the files you do have, and the remainder can be students suspended for 1-10 days. A total of 10 student files should be submitted. 
  • If the LEA does not have ANY students suspended greater than 10 days this school year, randomly select 10 students who have been suspended between 1-10 days for submission. 

 

Systematic Compliance (Prong 2) actions must be reviewed and approved within one (1) year of receiving the Compliance Review results notification.  

 

CAP Clearance 

LEAs will receive official notification that their LEA has cleared their CAP via the portal. Final CAP clearance letters come from the State Special Education Director.
